Cabinet appeals federal wine case decision

FRANKFORT, Ky. (Sept. 19, 2006) – The Kentucky Environmental and Public Protection Cabinet (EPPC) and the state Office of Alcoholic Beverage Control (ABC) have filed a notice of appeal in the case Huber Winery et al. v. Wilcher et al.  The appeal is being made to the U.S. Court of Appeals for the Sixth Circuit.

In a notice filed with the court today EPPC and ABC appealed the portion of a U.S. District Court ruling on Aug. 21 that the “in-person” purchase requirement in Kentucky’s small and farm winery laws is unconstitutional.

The appeal seeks to uphold Kentucky statutes requiring face-to-face transactions at small or farm wineries in or outside Kentucky.
